Terms and Conditions
Kingfisher Pty. Ltd. (ACN 051 079 960) provides the Site including all content and services subject to the following terms and conditions. By accessing the Site, you agree to be bound by the terms and conditions.
1. Kingfisher Pty. Ltd. will use reasonable efforts to maintain and operate the Site pursuant to this Agreement but does not warrant that operation of the Site will be uninterrupted or error-free.
2. Any use of the Site shall be at the sole risk of the user. Kingfisher Pty. Ltd. accepts no liability whatsoever for any error, omission or misstatement that may appear, or for any damage arising in any way from the information contained herein, including special, indirect or consequential damages.
3. You may not use the Site in a manner which is contrary to law, is disruptive or harmful.
4. No use of the site for commercial gain is permitted without the prior written consent of Kingfisher Pty. Ltd. Such use is subject to additional terms and conditions published separately but which form part of this agreement.
5. All content of the Site and all source code is protected by Copyright and may not be reproduced in part or whole without the prior written consent of Kingfisher Pty. Ltd. Consent is hereby given to the reproduction in whole, by print only, of any content page that is marked by us with the words “Let’s GO! Brochure” provided that such reproduction is for private use only and not for any commercial use or reward. Further reproduction of any such printed page in part or whole is prohibited without the prior written consent of Kingfisher Pty. Ltd. This consent excludes any content linked to the marked page, the source code of the marked page or any page linked thereto.
6. Kingfisher Pty. Ltd. reserves the right to refuse or to remove any access, information or materials, in its sole discretion, and without giving any explanation or notice.
7. You consent to Kingfisher Pty. Ltd. collecting information from any party and retaining information relating to your use of the Site and any services promoted therein, and you hereby authorise any party associated with the Site to provide us with such information. You further authorise Kingfisher Pty. Ltd. to disclose, on a confidential basis, to any party with whom Kingfisher Pty. Ltd. has business dealings all relevant information relating to your dealings with us and the Site.
8. You agree to indemnify and hold harmless Kingfisher Pty. Ltd., it’s officers, employees and Affiliates from and against any claims, actions, liabilities, losses, damages, costs and expenses, including reasonable legal fees, related to any breach of this Agreement by you or users of your account, or in connection with the use of the Kingfisher Pty. Ltd. Site or the Internet or the placement or transmission of any message, information, software or other materials on the Kingfisher Pty. Ltd. Site or on the Internet by you or users of your account.
9. If you are dissatisfied with the Kingfisher Pty. Ltd. Site or with any terms, conditions, rules, policies, guidelines, or practices of Kingfisher Pty. Ltd. in operating the Site, your sole and exclusive remedy is to discontinue use of the Site.
10. This Agreement constitutes the entire agreement between Kingfisher Pty. Ltd. and you. If any of the provisions contained in this Agreement be determined to be void, invalid or unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.
